Terms of use

These Terms of Use (the “Terms”) govern your use of the UniPOS Mobile Manager mobile app (the “App”). The App is provided by UniPOS (“UniPOS”, “we”, “us”). By signing in to and using the App you accept these Terms. If you do not agree with them, do not use the App.

1. The service

The App is a reporting and control tool for restaurants that use the UniPOS cloud point-of-sale system. It shows data from the restaurant’s UniPOS account — sales, receipts, stock, finance, staff and other figures — on a mobile device, and lets authorised users edit some records (for example menu items, categories and expenses).

The App is not a point-of-sale (POS) app: it does not take orders or issue fiscal receipts. All data shown in the App comes from the restaurant’s UniPOS account.

The commercial terms of UniPOS services (subscription, payment, service levels) are governed by a separate agreement between the restaurant and UniPOS. If these Terms conflict with that agreement, the agreement prevails.

2. Who may use the App

  • The App is for business use only. Users must be the owner of a restaurant that uses UniPOS or staff authorised by that restaurant.
  • Users must be at least 18 years old.
  • Accounts are not created in the App — they are created by UniPOS or by the restaurant in the web admin panel. The App only lets you sign in with an existing account.

3. Account and security

  • Keep your username, password and App PIN secret and do not share them.
  • You are responsible for all actions taken under your account.
  • If your device is lost or you suspect unauthorised use of your account, tell the restaurant owner or us (contact@unipos.tech) immediately and change your password.
  • The restaurant owner is responsible for which sections and branches staff accounts can access, and should promptly close the accounts of staff who leave.

4. Acceptable use

When using the App you must not:

  • try to access accounts, restaurants or branches you have not been given access to;
  • try to bypass, probe or disrupt the security mechanisms of the App or UniPOS servers;
  • decompile, reverse engineer or modify the App (except where the law expressly allows it);
  • send automated requests that place excessive load on the servers;
  • use the App for unlawful purposes or in a way that infringes the rights of others, including using restaurant customers’ personal data for anything other than the purpose of the service;
  • upload images or other content that is unlawful, offensive or infringes someone else’s intellectual property.

5. Data and privacy

The restaurant’s business data belongs to the restaurant. UniPOS processes it on the restaurant’s behalf to provide the service. How personal data is processed is explained in detail in the Privacy Policy.

Changes you make in the App (for example a product price or a waiter PIN) are applied directly to the restaurant’s UniPOS account and may affect how the POS works. Check that a change is correct before making it.

6. Accuracy of reports

Reports are built from data received from the restaurant’s POS terminals. Because a POS may work offline, synchronisation may be delayed, data may be entered incorrectly at the POS, or for other technical reasons, figures in the App may temporarily be incomplete or differ. Reports in the App are for information; for tax, accounting or other legally significant decisions, rely on official accounting records and professional advice.

7. Availability and updates

We make efforts to keep the service running without interruption, but outages may occur due to maintenance, updates, or failures of the internet or third-party providers. We may change, update or discontinue features of the App. We recommend using the latest version of the App for it to work correctly.

8. Intellectual property

The App, its code and design, and the UniPOS name and logo belong to UniPOS and are protected by law. These Terms give you a personal, non-exclusive, non-transferable and revocable right to use the App within the restaurant’s UniPOS services. Rights in the restaurant’s data and in content you upload remain with the restaurant or the respective right holders.

9. Limitation of liability

The App is provided “as is” and “as available”. To the maximum extent permitted by law:

  • UniPOS does not guarantee that the App will be error-free or uninterrupted;
  • UniPOS is not liable for indirect damage, lost profits, business interruption or loss of data;
  • responsibility for business decisions made on the basis of reports in the App lies with the person who makes them.

This section does not limit liability that cannot be excluded by law (for example, for intentional harm). UniPOS’s liability towards the restaurant is also governed by the service agreement.

10. Termination

You may stop using the App at any time — simply sign out and uninstall it. How to delete an account completely is explained on the Account deletion page.

Access to the App may be suspended if these Terms are breached, if the restaurant’s UniPOS subscription ends, or if the restaurant owner closes a staff account.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Azerbaijan. Disputes are first resolved through negotiation; if no agreement is reached, they are referred to the competent courts of the Republic of Azerbaijan.

12. Changes to these Terms

We may update these Terms from time to time. The new version is published on this page and the “Last updated” date changes. We give notice of significant changes through the App or the website. Continuing to use the App after changes means you accept the updated Terms.
